1. Overview & General Conditions

This website is operated by Filbys Fine Scale Models LTD (referred to as "we", "us", or "our"). By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service").

Please read these Terms of Service carefully before accessing or using our website. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates to our website.

2. Online Store & Contract Formation

  • Age Eligibility: By agreeing to these Terms of Service, you represent that you are at least the age of majority in your jurisdiction of residence.

  • Order Acceptance: The completion of the online checkout process does not constitute a binding contract. A contract between you and Filbys Fine Scale Models is only formed once your order has been dispatched and you receive a Shipping Confirmation email.

  • Right to Refuse: We reserve the right to refuse or cancel any order for reasons including, but not limited to: product availability, errors in product descriptions or pricing, or suspected fraud or unauthorized transactions.

3. Pricing, Products & Stock Availability

  • Pricing & Currency: All prices are displayed in GBP. Delivery charges are calculated and displayed separately at checkout.

  • Errors: In the event that a product is listed at an incorrect price due to a typographical error or technical glitch, we reserve the right to cancel any orders placed for items listed at the incorrect price, even after order confirmation.

  • Product Descriptions: We make every effort to display the colours and images of our products as accurately as possible. However, scale model packaging, decals, or minor manufacturer revisions may vary slightly from displayed images.

4. Shipping, Delivery & Risk

  • Delivery: We will deliver the goods to the address provided during checkout in accordance with our Shipping Policy.

  • Transfer of Ownership & Risk: Risk of loss or damage to goods transfers to you upon physical delivery of the parcel to your designated address (or a requested safe place). Ownership passes to you once full payment has been received.

5. Cancellation Rights & Returns (UK & Distance Selling)

Under the UK Consumer Contracts Regulations:

  • 14-Day Cooling-Off Period: You have the legal right to cancel your order within 14 days of receiving your items without giving a reason. You then have a further 14 days to return the goods to us.

  • Condition of Returned Items: Items must be returned in their original, unopened, and resalable condition. If the value of the goods is diminished due to unnecessary handling beyond what is necessary to establish their nature and function, a deduction may be applied to your refund.

  • Return Shipping Costs: Unless the item is faulty or delivered in error, you are responsible for paying the return postage costs.

6. Faulty or Defective Goods

Under the Consumer Rights Act 2015, goods supplied must be as described, fit for purpose, and of satisfactory quality.

  • If an item is faulty or damaged upon arrival, please notify us within 30 days for a full refund, repair, or replacement.

  • After 30 days, statutory remedies such as repair or replacement will apply.

7. Limitation of Liability & Intellectual Property

  • Intellectual Property: All graphics, branding, text, photographs, and website content are the intellectual property of Filbys Fine Scale Models or its suppliers and may not be reproduced without prior written permission.

  • Limitation: To the fullest extent permitted by law, Filbys Fine Scale Models shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our products or website. Nothing in these terms limits liability for death or personal injury caused by negligence.

8. Governing Law

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of England & Wales, and both parties agree to submit to the exclusive jurisdiction of the relevant courts.
